Special instructions for the working of Permanent and Continuous Pension Lok Adalat

 1.            Interested persons may file applications with sufficient details as per proforma given at Form A referred to under Rule 10(1)(i) of the Maharashtra State Lok Nyayalaya Rules, 1986 with necessary particulars at any office of District Legal Services Authority or High Court Legal Services Committee or High Court Legal Services Sub-Committee.          On receipt of the applications, the authority or the committee receiving applications shall verify from the applicants if his/her matter is pending before the Government, Court or Tribunal. The authority or the committee shall also obtain in writing from the applicant as to whether he/she want the application to be proceeded with at Mumbai, Aurangabad or Nagpur as per his/her convenience.           

2.         The High Court Legal Services Committee or Legal Services Sub-Committee on receipt of such applications shall make scrutiny of the said applications and in so far as the pre-litigation matters are concerned, they shall be registered and numbered as Pre-Litigation (Pension).  

3.         If the matter is pending before any Court or Tribunal then the concerned party may move the Court or Tribunal for referring his matter to the Permanent and Continuous Pension Lok Adalat. If the applicant makes a request in writing, the High Court Legal Services Committee or High Court Legal Services Sub Committee, as the case may be, shall send notice of the application to the concerned Registrar of the Court or Tribunal for placing the same before Honourable Judge or the Presiding Officer and for referring the matter to Permanent and Continuous Pension Lok Adalat as per Section 20(1) of Legal Services Authorities Act, 1987. 

4.         The State Government has notified the Scheme of Permanent and Continuous Pension Lok Adalat so there is no need of taking the consent of opponent officers of State i.e. State Government, Local Self Government or State Government Corporations. However, before referring the matter under section 20(1) of Legal Services Authorities Act, 1987 to Permanent and Continuous Pension Lok Adalat, intimation about the reference should be given to the Advocate/s on record and/or parties concerned, so that they can appear before Permanent and Continuous Pension Lok Adalat well prepared. 

5.         The High Court Legal Services Committee or High Court Legal Services Sub Committee should endeavour to notify the dates of sittings of Permanent and Continuous Pension Lok Adalat to all the parties concerned, if necessary by taking recourse to the media.   

6.         The High Court Legal Services Committee or the High Court Legal Services Sub Committee which is organising the Permanent and Continuous Pension Lok Adalat shall make arrangements of stay and transport of the head of the panel and panel members of Permanent and Continuous Pension Lok Adalat. 

7.         It shall also be seen by the Committee or sub-Committee organising Permanent and Continuous Pension Lok Adalat, that atleast one of the members of the Committee for taking Follow up Action is present on the date of holding of Pension Lok Adalat and on any other date/s as would be directed by Permanent and Continuous Pension Lok Adalat.
